Comeback complete, Europe wins Ryder Cup

MEDINAH, Ill. (AP) ? Erasing some of their worst Ryder Cup memories, the Europeans wore the image of Seve Ballesteros on their sleeves and played their hearts out Sunday at Medinah to match the greatest comeback in history and head home with that precious gold trophy.

Europe got its payback for Brookline, when the Americans roared back from the same 10-6 deficit. This rally was even more remarkable, carried out before a raucous American crowd that began their chants of "USA!" some three hours before the first match got under way.

Jose Maria Olazabal squeezed his eyes and fought back tears when Kaymer holed a 6-foot par putt to beat Steve Stricker and give Europe the point it needed to keep the cup. This was the first Ryder Cup since Ballesteros, the soul of European golf in this event, died last May of a brain tumor. Olazabal wanted his team to wear navy blue, Seve's favorite color, and added a clever touch ? his iconic silhouette on the sleeves of their shirts.

"This one is for all of Europe," Olazabal said. "Seve will always be present with this team. He was a big factor for this event for the European side, and last night when we were having that meeting, I think the boys understood that believing was the most important thing. And I think they did."

Tiger Woods missed a 3?-foot par putt on the 18th hole, and then conceded a par to Francesco Molinari of about that length to halve their match. That extra half-point made it a clear-cut win for Europe, 14?-13?.

Woods and Stricker, the anchors in the lineup, didn't win a single match at Medinah.

Ian Poulter was the first to embrace Olazabal, which was only fitting.

It was Poulter who gave Europe hope Saturday evening when he made five straight birdies to turn a loss into a win and swing momentum in Europe's favor. Poulter was up to his fist-pumping, eye-bulging tricks again on the final day, winning the last two holes in his match against U.S. Open champion Webb Simpson.

And he had plenty of help. Europe's top five players in the lineup all won, including Rory McIlroy, who was lucky to be playing. McIlroy thought his match was at 12:25 p.m. ? it was listed in Eastern time, not Central ? and needed a police escort to get to the course with 10 minutes to spare. Then, he came up with key birdies to hand Keegan Bradley his first loss of the week.

The biggest match might have belonged to Justin Rose. He was on the verge of losing to Phil Mickelson when Rose holed a 12-foot par putt to halve the 16th, made a 35-foot birdie putt from the back of the 17th green to win the hole, and then closed out Mickelson with a 12-foot birdie on the last hole.

Six of the 12 matches went to the 18th hole on Sunday. The Americans won only one of them.

The Americans also rallied from a four-point deficit to win in 1999 at Brookline. This was different, though. The Americans won big in those early matches. At Medinah, so many of them could have gone either way.

It was so close, so tense, that either side could have won the Ryder Cup down to the very end.

Stricker made an 8-foot par putt on the 18th, and Kaymer faced a par putt from 6 feet to win the match. If he missed, the Americans would get a half-point, and Woods was leading 1-up over Molinari and in the middle of the 18th fairway.

Kaymer, a former No. 1 and major champion who has struggled all year, poured it in the middle and the celebration was on.

He could barely speak at this point, not so much from pure emotion but having to scream over the crowd behind him. Players were hugging and crying, and the small European contingent that had been drowned out all week was serenading themselves with what has become the theme song of the Ryder Cup.

"Ole, ole, ole, ole," they sang merrily, even as the teams prepared for the closing ceremony.

Europe now has won seven of the last nine Ryder Cups, and even more remarkable about this comeback is that they did it on the road.

Davis Love III became the first U.S. captain to sit every player at least once before Sunday, wanting them to be fresh for the decisive day. Instead, the Americans faltered at the end ? especially Jim Furyk and Stricker, two of his captain's picks.

"The plan worked the first two days," he said. "It just didn't work today."

The only U.S. points came from Dustin Johnson, who went 3-0 in this Ryder Cup, Zach Johnson and unheralded Jason Dufner.

"We're all kind of stunned," Love said. "We know what it feels like now from the '99 Ryder Cup. It's a little bit shocking. We were playing so well, we figured it didn't matter how we sent them out there. We got a couple of matches flipped there in the middle that cost us."

Love thought all along the Ryder Cup would be decided in the ninth match by Dufner. It was most appropriate that Europe won the cup thanks to Kaymer.

Kaymer gave German golf some redemption from Kiawah Island in 1991, when countryman Bernhard Langer missed a par putt from about the same length that allowed the Americans to win.

"It's a feeling I never had before," Kaymer said. "On Friday, I sat down with Bernhard and talked a little bit about the Ryder Cup because my attitude was not the right one. But now I know how important the Ryder Cup is."

It means everything to Europe, and it showed.

They didn't have a home crowd to rally them, relying instead on the silence.

"Last time it was done, it was the American team in America," Lee Westwood said after closing out Matt Kuchar in 16 holes. "This would be against all odds. This would be the greatest comeback in the Ryder Cup ? ever."

And it was a collapse the Americans won't soon forget. Just 24 hours earlier, they had a 10-4 lead with two team matches still on the course ? they were ahead in one of them, while Woods and Stricker were closing in on the other. It's hard to believe they would only win 3? points the rest of the way.

Europe came out fast, and for McIlroy, that started at his hotel.

He was leisurely heading out of the hotel ? thinking that his tee time was an hour later than it was ? when he got a frantic call to tell him his match was in 25 minutes. McIlroy was lucky to run into the police, who helped him get to Medinah with enough time to change his shoes, take a few putts and head to the tee box.

He never trailed in his match, making two straight birdies late to knock off Bradley.

"It's my own fault," McIlroy said. "If I let down these 11 other boys and vice captains and captains this week, I would never forgive myself. I'm just obviously happy to get the point and help the cause out a little bit today."

Everyone pitched in.

Luke Donald, who makes Chicago his home and had a small share of gallery support, overwhelmed Bubba Watson despite being some 50 yards behind him off the tee. Paul Lawrie, returning to the Ryder Cup after a 13-year absence, had the shortest match of the day against FedEx Cup champion Brandt Snedeker. Poulter outlasted Simpson when the U.S. Open champion hit into a bunker on the 17th and made bogey, and then hit well long on the 18th when he needed a birdie to halve the match.

Still, the key point might have been delivered by Rose.

Mickelson surged ahead with a birdie on the 14th and still had a 1-up lead on the 17th. Behind the green, Mickelson hit a chip that looked like it might go in until the last turn. He was certain to make par. Rose drained his 35-footer to square the match, then finished off the birdie-birdie finish to a point Europe wasn't expecting.

"I was shaking a little bit and I said to myself, 'Rosey, this is what the whole week could come down to for you,'" he said. "Coming off the green here, I've looked down on my left sleeve, and that's the kind of thing Seve would have done for sure."

Jack Nicklaus first suggested in 1977 that all of Europe be included in the Ryder Cup, which brought the great Ballesteros into the matches. He was determined to prove that Europeans were equal to the Americans, and they have shown to be every bit of that over the last three decades.

We cover all of the biggest injury stories throughout the day on Friday, but feel free to use this as a one-stop shop to catch up on those posts and any other names worth mentioning that we?ll throw in here every Friday.

Panthers at Falcons

Linebacker Jon Beason is questionable for the Panthers and the team has already said that they won?t be moving Luke Kuechly to the middle in the event Beason can?t play on Sunday. Linebacker Thomas Davis is also questionable and guard Mike Pollak is out. For the Falcons, wide receiver Julio Jones is probable while cornerback Christopher Owens is the most notable of the four Falcons listed as out this week.

Bengals at Jaguars

The Bengals have issues at cornerback. Dre Kirkpatrick is still out and Jason Allen and Nate Clements are both doubtful. Leon Hall missed practice all week with a hamstring injury, but is listed as probable. Linebacker Daryl Smith is out for the Jags and they should get running back Rashad Jennings is likely to make his return to the lineup after being listed as probable.

Dolphins at Cardinals

Running back Reggie Bush and cornerback Richard Marshall are listed as questionable, but the expectation is that each of them will play this week. The news isn?t quite so good for Cardinals defensive tackle Darnell Dockett. He?s doubtful because of a hamstring injury and tight end Todd Heap and running back LaRod Stephens-Howling both earned the same designation.

Vikings at Lions

Both quarterbacks are probable after dealing with injuries this week. Linebacker Erin Henderson is out again for the Vikings thanks to a concussion, but defensive end Jared Allen is probable. Lions defensive tackle Corey Williams will miss the game after having knee surgery this week, running back Mikel Leshoure is questionable and safety Louis Delmas is doubtful as he makes an extended recovery from his own knee surgery.

Patriots at Bills

The Patriots will be without wide receiver Julian Edelman and tight end Aaron Hernandez. Tight end Rob Gronkowski, guard Logan Mankins and tackle Sebastian Vollmer are all questionable. The Bills hope to have running backs Fred Jackson and C.J. Spiller, although both are listed as questionable following limited practice participation this week.

Saints at Packers

Defensive end Turk McBride, linebacker David Hawthorne and linebacker Jonathan Casillas are all out for the Saints. Wide receiver Greg Jennings is probable for the Packers, as is running back James Starks.

Raiders at Broncos

Oakland has ruled out tackle Khalif Barnes and cornerback Shawntae Spencer for a second straight game. Running back Darren McFadden is probable after being slowed by a shoulder injury this week and wide receiver Darrius Heyward-Bey, while eager to get back on the field, is doubtful thanks to the blow to the head and neck he took in last week?s win against the Steelers. The Broncos are fairly healthy with the exception of safety Quinton Carter, who is out, and guard Chris Kuper, listed as doubtful.

Chargers at Chiefs

Chargers cornerback Shareece Wright is out again this week while tackle Jared Gaither has climbed the ladder to questionable while dealing with his ever-present back injury. Kicker Nate Kaeding is also listed as questionable, but he?s not going to Kansas City and Nick Novak will kick. The Chiefs offense could be in a tough way. Tight end Kevin Boss is out, running back Peyton Hillis is doubtful and three wideouts ? Dwayne Bowe, Steve Breaston and Dexter McCluster ? are all questionable.

49ers at Jets

The 49ers continue to list running back Brandon Jacobs and wide receiver Ted Ginn as questionable, just as they have before they?ve missed the team?s other games this season. Cornerback Darrelle Revis is out (and will be until his triumphant return for the Super Bowl) and wide receiver Stephen Hill is listed as doubtful, although you can go ahead and downgrade him based on Rex Ryan?s assessment of his chances of playing. Tight end Dustin Keller and linebacker Bryan Thomas, who have each missed the last two games, are questionable.

Seahawks at Rams

Seattle listed guard John Moffitt as doubtful and linebacker LeRoy Hill is questionable. The Rams will have another game-time decision with running back Steven Jackson and rookie defensive tackle Michael Brockers could make his regular season debut after missing the first three games with an ankle injury.

Titans at Texans

Tennessee wide receiver Kenny Britt and tight end Jared Cook are both questionable, although Cook was the only one to practice at all this week. The Texans listed wide receiver Lestar Jean as out and they have a slew of players, including quarterback Matt Schaub and running back Arian Foster, as probable.

Redskins at Buccaneers

Cornerback Cedric Griffin is out for the Redskins while wide receiver Pierre Gar?on and tackle Trent Williams have both been listed as questionable. The Buccaneers will be without cornerback Anthony Gaitor, but are otherwise injury free.

Giants at Eagles

The Giants won?t have tackle David Diehl again this week and cornerback Jayron Hosley and linebacker Keith Rivers have also been ruled out. Wide receiver Hakeem Nicks is doubtful and likely to miss a second straight game. Demetress Bell will start at left tackle for the Eagles in place of King Dunlap, but wide receiver Jeremy Maclin and defensive end Trent Cole are both probable for the game.

Goal Setting in Estate Planning for Farmers and Ranchers | NBI CLE ...

This is the first introductory glimpse at the materials for our upcoming ?Estate Planning for Farmers and Ranchers? CLE webcast to be held next week (October 3rd).

Providing a good plan to clients requires the correct balance of listening to what they are saying, hearing what they are not saying, and understanding what they should be talking about.? That is to say, counseling a client who owns a farm or ranch means respecting each client as a unique planning opportunity while keeping in mind the planning concerns that are generally applicable to farmers and ranchers.

Counseling the Client

Goal setting can be the most complicated part of the planning process, and if this step is not completed comprehensively, then all the legal techniques in the world are not going to allow the plan to execute properly because the plan is not oing to fit the client.? You need to know what it is that you as the attorney are being asked to ?solve.?

On the most basic level, the counselor role is defined by the professional rules of conduct that apply to attorneys.? These may differ in minor ways from state to state, but the general premises are universally applicable. (In Wisconsin, these rules are found in Wisconsin Supreme Court Rules Chapter 20: Rules of Professional Conduct for Attorneys.)? The first question is, who is your client?? The ansewr to this question is essential to practicing within the applicable ethical requirements.? ?The client? is whose interests you are representing, and the person whose voice should be carrying the most weight throughout the planning process.? the client is to whom you owe the duties of confidentiality and due diligence.? (WIS. SUP. CT R. 20:1.3-1.4)? This is the person with whom you should be entering into the representation agreement/engagement agreement/fee agreement. (WIS. SUP. CT R. 20:1.5)

Determining the identity of your client is relatively straightforward when handling a criminal matter, or a personal injury lawsuit, or even a single person estate plan.? However, this can be substantially more complicated when working with owners of farms and ranches.? these are often family businesses with a lot of people who have a lot of interests.? The person whose interests you are representing may not be the same person who has expressed a willingness to pay for your services or the same person who has offered to be a key contact person for phone calls and emails.? Failing to recognize that the decisions of one family member cannot be taken for granted as the decisions of the client could mean violating rules that pertain to conflicts of interes. (WIS. SUP. CT R. 20:1.7-1.8? Violating conflict of interest urles can then lead to formal reprimands, the forfeiture of fees, and/or removal from the representation of either or both clients. For a recent example of this in Wisconsin, see In re the estate of Rebecca Derzon v. Johnson. 2011AP377)

It is beneficial to include other family members in the planning process in addition to the client.? Succession planning requires key individuals who are part of that plan understand the plan, and also requires an attorney understanding of how much heirs are capable and willing to contribute in terms of financial contributions and effort.? heirs may be able to identify the gradual decline of mom and/or dad?s physical and mental capabilities.? On the other hand, mom and day may know best which children are the most financially competent.? Furthermore, other individuals who are not directly part of the plan but have valuable information to contribute, such as accountants and financial planners, are alsouseful people to have at the table.? Inclduing everyone in the conversation may save a substantial amount of time in terms of making sure information is adequately disseminated to all key players in an accurate manner.? This may include keeping that initial referral source in discussions if he or she was the initial troubleshooter.

To make sure the interests of the client are kept at the forefront throughout the planning process, conflict waivers should be utilized and explained to make sure everyone knows who the clients are and what that means for everyone else before any planning takes place (see WIS. SUP. CT R. 20:1.7). If the client grants someone else permission to communicate or receive information on their behalf, channels of communication directly with the clients should still be maintained to ensure that the clients? interests are not lost when others are included in the process (see WIS. SUP. CT R. 20:1.4).? This may mean one meeting with everyone and another meeting just with the clients.? This means figuring out a way to separate a dominant client from a more passive client to make sure both of them are represented fully.? Different attorneys will have different strategies for addressing this issue, but no matter the method, the objective should be the same.

The goal setting part of the estate planning process requires attorneys to utilize the ?counselor? part of the profession.? Farmers and ranchers are generally emotionally invested in the business, rather than looking at their businesses from a detached investment perspective.? An attorney must be able to listen to clients and others and pick up subtle cues regarding family dynamics, as well as the willingness and ability to proceed with a particular course of action.? This means knowing when to ask the hard follow-up questions, or knowing when to question an unenthusiastic response.

Substantive Considerations

Attorneys provide value in terms of understanding the variety of legal techniques and the considerations that are required before proceeding with those techniques.? Clients have often fixated on one or two key concerns that have brought them to your office.? the legal techniques of which they have knowledge depends o n their sophistication with legal matters, but often is based on what their relatives/friends/neighbors have experienced.? Aside from identifying the client and opening those channels of communication with the client, goal setting requires making sure that you have touched ont he possible areas of concern before suggesting a particular course of action with the client.

The following are possible concerns that should be considered regardless of whether the client articulates them as goals:

  1. Providing for owners during their lifetimes.? Consider retirement plans, the cost of long-term care, planning for a surviving spouse, and maintaining a particular standard of living.
  2. Providing for heirs.? Is the point simply to make sure that all the heirs ?get something,? or is there a particular plan of distribution that would make the most sense?? Should all the heirs be included in this process?
  3. Keeping the business in the family.? If the farm/ranch should continue to be run by family members, which family members, and how are they going to make that work financially and interpersonally?
  4. Minimizing financial costs. Minimize taxes on income, gifts and the estate; measure attorney fees versus probate administration fees, protect against creditors.
  5. Ease of administration.? Can key players properly administer a corporate entity and execute installment sales, or will a more straightforward (if slightly less optimal) plan be more likely to be administered effectively?

Some preparation can be done ahead of this meeting through making sure the initial contact with the client is productive.? Providing the client with introductory materials to better understand what planning invovles amay help them be better prepared and have less apprehension going into the initial meeting.? Likewise, asking for information from potential clients ahead of time, such as information on their family, their business and their finances can help you know in general what items will likely need to be discussed at that meeting.? Asking for them to spell out their specific concerns can provide an understanding of what they are expecting out of the initial meeting and the planning proess as a whole.

India launches communication satellite GSAT-10 ...

Bangalore: India?s advanced communication satellite GSAT-10 was successfully launched early today on board Ariane-5 rocket from Europe?s spaceport in French Guiana. GSAT-10, with a design life of 15 years, is expected to be operational by November and will augment telecommunication, Direct-To-Home and radio navigation services. At 3,400 kg lift-off, GSAT-10 is the heaviest built by the Indian Space Research Organisation. It was ISRO?s 101st space mission.
GSAT-10 is fitted with 30 transponders, 12 Ku-band, 12 C-band and six Extended C-Band, which will provide vital augmentation to INSAT and GSAT transponder capacity. It also has a navigation payload GAGAN, GPS aided Geo Augmented Navigation that would provide improved accuracy of GPS signals to be used by Airports Authority of India for civil aviation requirements.

This is the second satellite in INSAT and GSAT constellation with GAGAN payload after GSAT-8, launched in May 2011.

ISRO Chairman K Radhakrishnan was at space agency?s Master Control Facility at Hassan in Karnataka. Minutes after the launch he said the Master Control Facility has already taken command and control of the satellite. He said they expect to operationalise GSAT-10 and make it available to the user community by November this year.

According to the CDC, African American men have the highest incidence of prostate cancer of any race in the U.S. and are more than two times more likely to die from the disease. In fact, prostate cancer is the fourth leading cause of death in African American men.

Unfortunately, this means that receiving a prostate cancer diagnosis is something many Black men will encounter in their lifetime. How a man responds to this news can be a matter of life and death.

After you?re diagnosed with prostate cancer, it?s very important to make the necessary lifestyle changes that will improve the quality of your life.

According to Dr. Thomas Farrington, prostate cancer survivor and president and founder of the Prostate Health Education Network (PHEN), here are some of the top things a man with prostate cancer needs to stay healthy.

1. Knowledge

?Knowledge is the best tool to help you survive,? Dr. Farrington says. ?Black men need to ask ?should I be treated or go into active surveillance?? ?What is my stage of cancer?? ?Surgery or radiation?? Men don?t understand that you must continue to be diligent in post-prostate cancer treatment.?

There are many resources available to learn about prostate cancer facts and treatments, such as PHEN and the National Comprehensive Cancer Network.

Dr. Farrington also stressed an underlying reason for men to educate themselves about recommended lifestyle habits and possible treatments, in addition to maintaining a higher quality of post-cancer life ? prostate cancer recurrence.

?Just because you?ve received treatment doesn?t mean the cancer can?t come back, so men to know about available treatments, particularly new treatments that are on the horizon. An example of this is an exiting new treatment that addresses prostate cancer recurrences called Provenge, which uses the body?s own immune system to fight cancer. Many insurance companies cover this, and it?s important for men to be aware of this new option.?

2. The Right Diet

It can be very difficult to adhere to a balanced cancer diet, particularly during treatment, while your body is working overtime to fight the cancer and repair healthy cells that may have been damaged as a side effect of treatments like chemotherapy and radiation. At the same time, many cancer treatments, such as radiation, can leave you weak and without an appetite ? this makes it both challenging, yet crucial, to get in those essential nutrients, vitamins, and minerals your body needs in order to fight and regain strength.

?You really do need to be concerned with your diet,? says Dr. Farrington. ?One key aspect of a prostate cancer diet is being lower in fat.?

Experts also recommend reducing animal fat in your diet. Studies show that excess fat, primarily red meat and high-fat dairy, stimulates prostate cancer growth. In addition, avoid trans fatty acids (found in margarines, fried and baked goods) and high-calcium diets, which are also both known to promote cancer growth.

Rory Hamilton-Brown signs with Sussex ? Cricket News Update

Rory Hamilton-Brown, ex-Surrey captain, has signed with his former club Sussex after seeking a move from Surrey following the death of teammate and close friend Tom Maynard.

Maynard, a former Surrey batsman, who was also affiliated with the England Lions, passed away abruptly in June this year, in a tragic train accident which shocked the cricketing world. His teammates at Surrey were the worst-hit by the tragedy, particularly skipper Hamilton-Brown, who had been close friends with the deceased cricketer.

The 25-year-old was placed on compassionate leave, but struggled to regain his form despite nearly a month away. He was eventually given permission by team director Chris Adams at the start of September to seek a fresh start with a new club in order to start anew. For this purpose, Surrey released him from the new deal he had signed, which bound him to the club until 2014.

Faced with a choice between Somerset and Sussex, Hamilton-Brown, eventually chose to return to Sussex, a club with which he had previously been affiliated.

?I would like to thank Surrey for the opportunity they gave me to captain such an illustrious club ... I am immensely proud of what I achieved there, both as a captain and a player,? said Hamilton-Brown.

Free skin-cancer screenings planned in October | MailTribune.com

A free skin-cancer screening for the uninsured and underinsured is planned from 6 to 8 p.m. Oct. 4, 10, and 16 at Community Health Center, 19 Myrtle St., Medford. Registration is required and may be made by calling 541-414-8592. A limited number of appointments are available; no walk-ins will be taken.

The screening will be done by local dermatologists and the American Academy of Dermatology in partnership with the Community Health Center.

Likely candidates for the screening are those with fair hair, fair skin, who grew up in a sunny location, have a history of tanning-bed use and have no insurance and/or are experiencing financial hardship.

The event will provide uninsured and underinsured people the opportunity to receive a free screening and is part of the American Academy of Dermatology's ongoing effort to increase the focus on preventive health care.

"People with lighter skin are at greater risk and should check their skin regularly for early warning signs of skin cancer," Dr. Judith Oursler, a dermatologist with Rogue Valley Dermatology and volunteer coordinator of the event, said in a press release. "We'll check moles and other spots for signs of cancer and determine if further analysis is necessary."

More than 3.5 million cases of skin cancer are diagnosed yearly in the U.S., according to statistics from the American Cancer Society. If detected early, skin cancer can be successfully treated.

Physicians volunteering for the screening include Denise Burke, J. David Igelman, Jeri Mendelson, Douglas Naversen, Judith Oursler, Dwight Tribelhorn, David Trask and Margo Herron.

Brazilian court bans anti-Islam film from YouTube

RIO DE JANEIRO (AP) ? A judge in Brazil has ordered YouTube to remove clips of the movie that has touched off deadly protests across the Muslim world, the court said in a statement.

Judge Gilson Delgado Miranda gave the video-sharing site ten days to remove videos of the film, "Innocence of Muslims." After that, YouTube's parent company, Google, will face fines of $5,000 a day for every day the clips remain accessible in Brazil, according to the statement posted on the court's website late Tuesday .

The lawsuit was filed by a group representing Brazil's Muslim community, the National Union of Islamic Entities, which claims the film violates Brazil's constitutional guarantee of religious freedom for all faiths.

In a statement on the group's website, Mohamad al Bukai, the head of religious matters for the Sao Paulo-based organization, hailed the ruling as a victory.

"Freedom of expression must not be confused with giving disproportionate and irresponsible offense, which can provoke serious consequences for society," al Bukai said.

The statement also includes excerpts from the ruling, in which the judge stresses "this type of jurisprudence cannot be confused with censorship," which he defines as "the undue restriction of the civic consciousness."

Courts or officials in other countries also have sought to restrict access to clips of "Innocence of Muslims," renewing the debate over freedom of expression in the Middle East, the United States and Europe.

The film's portrayal of the Prophet Muhammad as a fraud, a womanizer and a child molester, has enraged many Muslims. At least 51 people, including the U.S. ambassador to Libya, have been killed in violence linked to protests over the film.

The Sao Paulo court's ruling came on the same day that Brazilian President Dilma Rousseff addressed the United Nations and urged an end to prejudice against Muslims.

The ruling follows a rash of other Brazilian court rulings against Google stemming from Brazil's strict electoral laws, which restrict what critics can say on television and radio about candidates for office. Ahead of municipal elections next month, Google has been repeatedly requested to remove videos that violate those restrictions, and on Tuesday, a judge in Mato Grosso do Sul state ordered the arrest of the head of Google's operations in Brazil for failure to remove YouTube videos that attacked a mayoral candidate.

Google said in an emailed statement on Tuesday that it was appealing the decisions regarding electoral laws and content removal. The company did not respond to requests for comment Wednesday about the "Innocence of Muslims" case.

Earlier this month a judge in Parana state in southern Brazil ordered that Google pay $500,000 for each day that it balked in fulfilling an order to remove videos from YouTube that attacked a candidate. In the northeastern state of Paraiba, a judge also ordered the imprisonment of another Google executive in Brazil earlier this month, also for not removing videos from YouTube attacking a mayoral candidate. That order was overruled by a higher court.

(AP) ? Despite being constrained by mental illness and the loss of his left leg and arm, Brian Claunch had spent much of the past decade finding opportunities to run away from residential care facilities where he had been placed, preferring to live on the streets.

In recent months, Claunch had seemed to settle into some stability, staying put, taking his medications. But all of that abruptly ended this past weekend in a confrontation with police in which the 45-year-old man in a wheelchair was fatally shot by an officer.

While his criminal and medical history did not seem to indicate violent tendencies toward others, Claunch had his ups and downs, according to John Garcia, the owner of Healing Hands Assisted Home Care, where Claunch had been living. The worst aspects of his mental illness burst forth when he wouldn't calm down after demanding cigarettes and soda around 2 a.m. Saturday, Garcia said.

A caretaker called police. Authorities say Claunch cornered a responding officer with his wheelchair and waived a shiny object in his hand. The other responding officer, fearing for his partner's life and his own safety, shot Claunch in the head, police said. The shiny object turned out to be a ballpoint pen.

Since the shooting, community and civil rights groups have called for changes in how officers are trained and disciplined. Houston Police Chief Charles McClelland has called the shooting tragic but asked people to reserve judgment until the department's investigation is completed. The FBI is monitoring the case.

Garcia, who was not at the home when the shooting happened, tearfully recalled a loving but also at times quarrelsome man. Claunch had been diagnosed with paranoid schizophrenia, a chronic condition in which people see and hear things that aren't there.

"He was aggressive. As far as violent, I don't know," Garcia said. "Every time (Claunch) got into a situation with me, I would just say, 'Brian, calm down, calm down,' and I would walk away from him and in an hour or two he would be OK."

According to court records, Claunch lost his left arm and leg because "he firmly believed that the devil was in the left side of his body so he (decided) to lay down on the railroad tracks and waited for a train to come and (dismember) him."

A mental status examination in 2002 found Claunch was "pleasant and cooperative" but had a history of psychiatric hospitalizations over the prior decade. He was unable to work and would not take his medications, leading to him "hearing voices."

In 2003, a probate court judge declared Claunch a ward of the Harris County Guardianship Program.

Court records show Claunch's mother initially petitioned to be her son's guardian but changed her mind. Records show Claunch also had a brother and sister. Efforts this week to reach his family were unsuccessful.

During the first two years of his guardianship, Claunch did well, living in a personal care home in Houston, according to annual reports submitted to the probate court.

But by 2006, Claunch started running away, panhandling on local streets. Over the next few years, he went missing, was hospitalized and was in and out of jail on drug and trespassing charges. He also stopped taking his medications.

In 2010, he was placed at a state mental hospital in East Texas for several months.

He started living at Healing Hands in May 2011 but ran away after four months. He was found and brought back in March. At Healing Hands, located in a three-bedroom home, Claunch lived with two other men.

Estella Olguin, a spokeswoman for the Harris County Guardianship Program, said in the time Claunch was a ward of the county, he lived in at least 12 facilities. After coming back to Healing Hands, "he seemed to do really well," she said.

Garcia, 62, said he had twice before called police about Claunch ? both times because he left the home and refused to return.

Claunch had seemed fine Friday night, said Garcia, who had given him a pack of cigarettes, two sodas and his medication before leaving around 8 p.m.

But Claunch, a chain smoker, went through his cigarettes and soda and around 2 a.m. began aggressively demanding more of both from the overnight caretaker.

The caretaker called 911, initially telling the operator he was having problems with a mentally ill person. Because of static on the line, it's unclear if the operator knew about Claunch's mental condition, Garcia said.

Citing the ongoing investigation, Houston police spokesman John Cannon said he could not comment on whether the responding officers knew of Claunch's mental state. Healing Hands does not have any signs outside saying it is a facility for mentally ill or physically challenged individuals.

According to police, Claunch threatened to kill the two officers and tried to stab one with the shiny object in his hand.

The officer who shot him, Matthew Marin, had fatally shot another suspect in 2009, firing on a man who was stabbing his neighbor to death and refused to drop the knife. A five-year veteran, Marin was placed on three-day administrative leave after Claunch's death.

Garcia said he is still in shock and is reserving judgment on whether the shooting was justified.

"I love Brian. He was one of God's children and that's the way I look at him," he said.

Social media marketing in property management? | - Real Estate Jobs

First of all, let?s get that question out of the way. Yes, I know what you?re thinking. Is there an expected return on investment using social media marketing in property management?

Well, it?s like this. Creating a Facebook page, or creating a social media presence, won?t mean that you are automatically going to be sent cheques or that its automatically going to grow your rent roll every month. You do have to work to achieve a result.

Social media is about focusing on building relationships. If you do the right things, then the return on investment will come. You actually need to consider what the ROI is of not using the latest, greatest, and best technologies available to you as a business.

In the short term, not being on social media may not affect you, however long term it could see you working hard to play catch up. Let me put it this way ? remember when nobody had a website ? remember when no one had a mobile phone? Technology advances and then people play catch up.

Now let?s talk about why you should use social media in your property management division. What are the advantages?

  1. To Position Yourself or Your Company as The Expert in Your Area or Your Niche
    Social media allows you to demonstrate to potential clients, that you are the expert with in your local area. You can quickly niche to certain areas and develop a strong brand within that niche. Niching your property management division online allows you to also then niche to certain suburbs, or types of property ? for example waterfronts or apartments. The idea online, is to market more generally, then niche down into other divisions. You should aim to build a massive online profile in your area, demonstrating through various methods that you are the expert and therefore the logical choice. You are a location-based business. This means you only have to be the best at online marketing in your area. If your competitors are not using the Internet and they are not using social media, you have a massive head start. If they are however, it would be wise to make a start now, instead of playing catch up later. Don?t be left behind. You have a massive window of opportunity now. The same things apply to property management as they do to sales: use video, have a blog, tackle some of the tools such as Facebook, Twitter and Pinterest.
  2. Promote yourself and Your Company Online Free of Charge
    Social media allows you to promote yourself and your company online free of charge. Every piece of content you place online, stays online. When you advertise in print media, it?s gone tomorrow. Distributing content online, will assist you to build a substantial online profile fast! You have the potential to promote your business to a pool of 800 million people! That?s the potential database of Facebook. You already have a captive audience already glued to Facebook. Tap into your target market.
  3. Use Social Media to Drive Traffic to Your Website
    The purpose of using social media is to build relationships. Think about social media strategies similar to throwing out a net. You are fishing on social media for new landlords and tenants. Once you find someone that might be interested in what you are doing, the aim is to capture those people and entice them to your own website. Once they arrive at your website, you should then have a system for collecting their names and details.
  4. Become the Human Touch
    The fantastic thing about social media, is that you can project and enhance the human side to your property management department. It personalises your company and shows potential clients that you are more than just a logo. It is also easy to become the face of your business. If you are effective at doing this, people will get to know you and want to do business with you.
  5. Protect Your Brand
    If you are not active online and you are not trying to build a massive online profile, it is a fact that you are at the mercy of any disgruntled tenant or landlord. I know of one property manager who did all the right things with a tenant ? the tenant didn?t like the fact they had to repair a few things at the property he was living in ? so he then posted not so nice things about the property manager and the company on a blog. Now, when you Google the property managers name, the tenants article comes up on page one of Google. Having this on page one of Google, could be potentially damaging to your reputation and to your brand. If you are not on top of this, it could cost you business. Remember that it?s essential to have brand protection strategies in place.
  6. You Can Magnify Your Brand
    If you are new to property management or your company is new, the great thing is that you can create massive amounts of content online, to give you a solid foundation so that landlords or tenants feel comfortable dealing with you. Through creating a lot of content online, your company can appear to have a solid history in your area, giving you more credibility and therefore instilling confidence to potential customers.
  7. Keep In Contact with Your Past, Present and Future Clients
    Think of social media like a database. The aim in any business I believe is to create raving fans, who in turn become friends. If your customers become your friends, they can also become your social media friends. Recently I was lucky enough to ask Tim Ferris (author of The 4 Hour Work Week) a question about how he built his name and his following ? he said he ?just built raving fans?. Basically his advice was to build 100 loyal raving fans and keep building onto that. He said, that you want to get to a point where your raving fans are doing your marketing for you. Social media allows, past, present and future clients to relate to you on a personal level. They can see your values, your hopes, and dreams. You can build commonality with someone before you even meet. Just remember too, that 80% of people will Google you before they even meet you. Work at building great positive content online.

A word of warning though ? remember when you have your clients, friends, and followers on display for everyone to see on social media ? you are also on display. Always be responsible for your own reputation. Don?t outsource your status updates as this outsources your reputation. For example, there have been numerous cases of intoxicated people making posts they thought they were making on their personal page, onto their business page. Those posts have gone viral and once it?s out there, your company is at the mercy of the public scrutiny. Be careful who manages your social media ? it?s your reputation and your business.

Social media is fun, its free, its effective and there is a lot of training and tips out there, I encourage you to get in there and have a go.

US State Dept. blasts CNN report on Stevens' diary

LOS ANGELES (AP) ? CNN reported on the personal journal of slain American ambassador Christopher Stevens over objections from his family, a State Department spokesman said Saturday.

The news channel, in a story posted online Saturday, said that it found a journal belonging to Stevens four days after he died in a Sept. 11 attack on the U.S. consulate in Benghazi, Libya. Three other Americans also were killed.

CNN broke a pledge to the late ambassador's family that it wouldn't report on the diary, said State Department spokesman Philippe Reines, a senior adviser to U.S. Secretary of State Hillary Rodham Clinton.

In a blistering statement, Reines called CNN's actions "indefensible."

The channel said in the story online that it took "newsworthy tips" from Stevens' diary and confirmed them with other sources. Citing an unidentified source "familiar with Stevens' thinking," CNN said that the ambassador was concerned about security threats in Benghazi and a "rise in Islamic extremism."

In a statement Saturday, CNN defended its use of the journal's contents and asked "why is the State Department now attacking the messenger."

"CNN did not initially report on the existence of a journal out of respect for the family, but we felt there were issues raised in the journal which required full reporting, which we did," the channel said.

The public has a right to know what CNN learned from "multiple sources" about fears and warnings of a terror threat before the Benghazi attack, the channel said, "which are now raising questions about why the State Department didn't do more to protect Ambassador Stevens and other U.S. personnel."

Stevens' family was informed within hours about the discovery of the journal, a hard-bound book that included seven handwritten pages. It was returned to them via a third party, according to CNN's online story.

An Italian official took control of the diary from CNN in Benghazi at the State Department's request, and it is en route back to Stevens' family, the department said.

"Given the truth of how this was handled, CNN patting themselves on the back is disgusting," Reines said in his statement.

"Whose first instinct is to remove from a crime scene the diary of a man killed along with three other Americans serving our country, read it, transcribe it, email it around your newsroom for others to read" and then call the family?" Reines asked.

In a phone call with the Stevens family, CNN "agreed to abide by the clear wishes of the Stevens family, and pledged not to use the diary or even allude to its existence until hearing back from the family," Reines said.

But four days later, "they just went ahead and used it," he said.

The diary was first mentioned on-air Friday by Anderson Cooper, following previous CNN reports that Stevens feared he was on an "al-Qaida hit list" but did not mention the journal. Cooper said that some of the information in the reports was based on Stevens' personal journal, which he said CNN came across in its reporting.

In its online story, CNN said it found the journal on the "floor of the largely unsecured consulate compound where he was fatally wounded."

Asked to comment on CNN's report that Stevens was concerned about a "hit list," Reines referred to a news conference last Thursday at which Clinton was asked about it.

"I have absolutely no information or reason to believe that there's any basis for that," Clinton had said.

The Equipment Leasing & Finance Foundation releases the September 2012 Monthly Confidence Index for the Equipment Finance Industry (MCI-EFI) today. Overall, confidence in the equipment finance market is 53.0, up from the August index of 50.2, reflecting increased optimism despite concerns over companies? willingness to expand their businesses in the face of economic and political uncertainty.

When asked about the outlook for the future, MCI survey respondent Anthony Cracchiolo, president and chief executive officer, vendor services, U.S. Bank Equipment Finance, said, ?The industry is performing well and new businesses are entering the segment to join the positive experience our asset class enjoys. However, the growth of our industry is tightly aligned with the overall U.S. economy and our industry?s future will be determined by the broader actions of the U.S. economy.?

September 2012 Survey Results:

?When asked to assess their business conditions over the next four months, 8.8% of executives responding said they believe business conditions will improve over the next four months, up from 6.3% in August. 73.5% of respondents believe business conditions will remain the same over the next four months, down from 78.1% in August. 17.6% believe business conditions will worsen, up from 15.6% the previous month.

?11.8% of survey respondents believe demand for leases and loans to fund capital expenditures (capex) will increase over the next four months, an increase from 6.3% in August. 76.5% believe demand will ?remain the same? during the same four-month time period, up from 75% the previous month. 11.8% believe demand will decline, down from 18.8% in August.

?14.7% of executives expect more access to capital to fund equipment acquisitions over the next four months, down from 15.6% in August. 85.3% of survey respondents indicate they expect the ?same? access to capital to fund business, an increase from 84.4% the previous month. No survey respondents expect ?less? access to capital, unchanged from August.

?When asked, 29.4% of the executives reported they expect to hire more employees over the next four months, down from 31.3% in August. 67.6% expect no change in headcount over the next four months, up from 65.6% last month. 2.9% expect fewer employees, down from 3.1% of respondents who expected fewer employees in August.

?76.5% of the leadership evaluates the current U.S. economy as ?fair,? up from 68.8% last month. 23.5% rate it as ?poor,? down from 31.3% in August.

?5.9% of survey respondents believe that U.S. economic conditions will get ?better? over the next six months, down from 6.3% in August. 79.4% of survey respondents indicate they believe the U.S. economy will ?stay the same? over the next six months, up from 78.1% in August. 14.7% believe economic conditions in the U.S. will worsen over the next six months, a decrease from 15.6% who believed so last month.

?In September, 29.4% of respondents indicate they believe their company will increase spending on business development activities during the next six months, up from 15.6% in August. 70.6% believe there will be ?no change? in business development spending, down from 81.3% last month, and no one believes there will be a decrease in spending, down from 3.1% last month.

With the end of the season looming, it?s time for Fredi Gonzalez and the Braves to begin turning their attention toward the postseason.

This year, Major League Baseball will introduce the new Wild Card round, where the teams with the best records that did not win their divisions will face off in a single game series. Unless the Washington Nationals suffer a drastic change in fortune, it seems the Braves are headed for this single game series.

This game must be managed differently than a traditional playoff series, where the importance is on winning a majority of the games rather than one game in particular.

After all, teams in the postseason need only win 11 of 19 games in the Division, League and World Series to win the championship.

Forcing teams to focus on a single game changes the nature of baseball. When winning or losing a single game will change the season, the sport more closely resembles college football.

Even the roster rules are different in this new Wild Card round.

The Braves are allowed to set a 25-man roster for the Wild Card game, and then set a new roster for the rest of the postseason. This means that the Braves will not have to include all their starting pitchers on the roster for the Wild Card round. Instead, the team can add additional bench and bullpen players to increase their flexibility in this winner-take-all game.

This roster rule has led many to wonder if teams in the Wild Card round should abandon starting pitching altogether and use a variety of relief pitchers throughout the game. The benefits of this method are numerous. The team would keep all their starting pitchers fresh for the rest of the postseason and be able to use their expanded bullpen to focus on left-handed/right-handed matchups and use specialists to get outs when the situation calls for it.

Using several relief pitchers instead of a starter will also keep batters from becoming acclimated to a pitcher?s style. Rather than allow batters to become familiar with a starting pitcher during the second or third time through the lineup, batters would be forced to adjust to a different pitcher each time at the plate.

Using this patchwork pitching strategy also makes it more difficult for the opposing manager. They will have to adjust their lineups more frequently and change their game plans on the fly.

For example, if a manager knows they will face Tommy Hanson pitcher for several innings, they will probably try to play small ball in the early innings. They will attempt to steal more bases to manufacture runs because Hanson has a notoriously bad pick-off move. If the manager doesn?t know who will be pitching for an at-bat until the batter steps into the box, they will have to adjust their strategy quickly after they find out.

The notion of using the bullpen for nine innings is an extension of the ?Moneyball? approach that the Oakland Athletics pioneered in the early 2000s. Where that strategy involved selecting hitters with a high on-base percentage, rather than batting average, this strategy dictates selecting pitchers for their ability to get outs in specific situations, rather than ERA.

It is certainly a radical idea, but teams in the Wild Card round are in untested waters. No one knows what strategy will work for this game because no one has played a game like this before. It seems unlikely that a manager will attempt such a risky and unorthodox approach with so much on the line, but a new strategy might be necessary because this game is so much different than any other the team might play.
